Welcome to HauntGlow.

These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the HauntGlow website, online store, products, services, content and related features (collectively, the "Services").

The terms "HauntGlow", "we", "us" and "our" refer to HauntGlow, the seller and operator of this online store. HauntGlow is powered by Shopify, which provides the technology and infrastructure that enables us to operate our online store.

By accessing our website, browsing our store, creating an account, placing an order or otherwise using our Services, you agree to be bound by these Terms and our applicable policies, including our Privacy Policy, Refund Policy and Shipping Policy.

If you do not agree with these Terms, you should not access or use our Services.

These Terms apply to customers purchasing products online, including customers located in the United States and other countries where we offer shipping.

SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION

By using our Services, you represent that you are at least the age of majority in your jurisdiction of residence.

After you submit an order, you will receive an order confirmation by email. An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance of the order.

We reserve the right to accept, refuse or cancel an order for legitimate reasons, including product availability, pricing or description errors, suspected fraudulent activity, payment issues, shipping restrictions, or other circumstances permitted by applicable law.

If we cancel an order after payment has been received, we will issue an appropriate refund for the amount paid for the cancelled order.

Once an order has entered processing or fulfillment, cancellation may no longer be possible. If cancellation is not possible, you may use the applicable rights under our Refund Policy.

SECTION 4 — PRICES, PAYMENTS AND TAXES

All prices displayed on our website are stated in the currency indicated at checkout.

Prices may change at any time before an order is placed.

The price applicable to your purchase is the price displayed at checkout when you submit your order.

Depending on the destination country, applicable taxes, customs duties, import charges, brokerage fees or other governmental charges may apply.

Unless expressly stated otherwise at checkout, customers are responsible for any customs duties, import taxes or other charges imposed by the destination country in connection with an international shipment.

We are not responsible for additional charges imposed by customs authorities or other governmental agencies.

You agree to provide accurate and complete payment information and confirm that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel transactions that appear to be unauthorized, fraudulent or otherwise unlawful.

SECTION 5 — SHIPPING AND DELIVERY

HauntGlow sells products exclusively online and may ship products internationally to destinations where shipping is available.

Shipping times displayed on our website are estimates unless expressly stated otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather, natural disasters, strikes, transportation disruptions, governmental actions or other events beyond our reasonable control.

For international orders, the customer is responsible for providing an accurate and complete delivery address.

Customers are also responsible for complying with applicable import requirements in their destination country.

If an order is delayed beyond the shipping period represented at the time of purchase, we will take reasonable steps to notify the customer and, where required by applicable law, provide the customer with the legally required options regarding cancellation, delay and refund.

Nothing in this section limits any rights provided to consumers under applicable law.

SECTION 6 — RETURNS, REFUNDS AND WARRANTY

Our products are covered by our applicable Refund Policy and 30-Day Warranty.

Unless a longer period is required by applicable law:

  • Customers may request a return within 30 days of receiving the product.

  • Returns because the customer changed their mind, no longer wants the product or simply does not like the product may be accepted subject to the conditions of our Refund Policy.

  • In such cases, the customer is responsible for the return shipping costs.

  • Products returned because of a manufacturing defect, damage attributable to HauntGlow or a malfunction covered by our warranty will not be subject to customer-paid return shipping where applicable.

  • The product must meet the applicable return conditions described in our Refund Policy.

Our 30-day warranty covers manufacturing defects, covered damage and malfunctions occurring during the warranty period.

The warranty does not cover damage caused by misuse, abuse, accidents, improper installation or use, unauthorized modifications, negligence, normal wear and tear, or use contrary to the product's instructions.

Our commercial 30-day warranty does not limit or replace any mandatory statutory warranties, guarantees or consumer rights that may apply in the customer's jurisdiction.

For customers located in the European Union or other jurisdictions providing mandatory consumer protections, those legal rights apply in addition to our commercial return and warranty policies.

SECTION 7 — INTELLECTUAL PROPERTY

All content included in or made available through the Services, including trademarks, logos, text, photographs, graphics, product images, videos, designs, layouts and other materials, is owned by or licensed to HauntGlow and is protected by applicable intellectual property laws.

You may use the Services solely for personal and lawful purposes.

You may not reproduce, distribute, modify, copy, sell, exploit or create derivative works from our content without our prior written permission, except where such use is expressly permitted by applicable law.

HauntGlow names, logos, product names, designs and slogans are trademarks or trade names of HauntGlow or their respective owners.

Shopify names, logos and trademarks belong to Shopify.

All other trademarks belong to their respective owners.

SECTION 8 — THIRD-PARTY SERVICES AND TOOLS

Our Services may contain or provide access to third-party services, applications, payment processors, shipping providers, analytics services or other tools.

These third-party services may operate under their own terms and privacy policies.

We do not control all third-party services and are not responsible for the independent actions, policies, availability or performance of third-party providers.

Your use of third-party services may be subject to the applicable third party's terms and policies.

SECTION 9 — THIRD-PARTY LINKS

Our Services may contain links to websites or services operated by third parties.

We provide such links for convenience and do not necessarily endorse or control those third-party websites.

We are not responsible for the content, policies, security, availability or practices of third-party websites.

Any transactions you conduct with third parties are subject to the terms and policies of those third parties.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

HauntGlow is powered by Shopify, which provides the technology and infrastructure used to operate our online store.

Purchases made through our store are transactions between you and HauntGlow.

Shopify is not the seller of products purchased from HauntGlow and is not responsible for the products, fulfillment, returns, refunds or other obligations arising from transactions between you and HauntGlow, except as otherwise required by applicable law.

SECTION 11 — PRIVACY

Your use of our Services is also subject to our Privacy Policy.

By using our Services, you acknowledge that information may be collected, processed and shared with service providers, payment processors, shipping providers, Shopify and other parties as necessary to operate our business and fulfill your orders.

Because our store is powered by Shopify, certain information may also be processed by Shopify in accordance with Shopify's applicable privacy policies.

SECTION 12 — CUSTOMER FEEDBACK AND REVIEWS

If you voluntarily submit reviews, comments, photographs, suggestions, testimonials or other content to HauntGlow ("Feedback"), you grant HauntGlow a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, modify and distribute such Feedback for legitimate business, marketing and promotional purposes, subject to applicable law.

You represent that you have the necessary rights to submit such content and that your submission does not violate the rights of another person.

We reserve the right to remove content that we reasonably believe violates these Terms, applicable law or the rights of others.

From time to time, our Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, shipping charges or other information.

If an error materially affects an order, we may cancel the affected order and provide an appropriate refund where required.

We may suspend or terminate your access to the Services where permitted by applicable law, including where you materially violate these Terms or engage in fraudulent, unlawful or abusive conduct.

Termination does not affect rights or obligations that arose before termination.

Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, indemnification, dispute resolution and governing law.

SECTION 16 — DISCLAIMER OF WARRANTIES

Except for warranties expressly provided by HauntGlow and any warranties or consumer guarantees that cannot legally be excluded, the Services are provided on an "as available" basis.

We do not guarantee that the website or Services will always be uninterrupted, secure or error-free.

We do not exclude or limit any warranty, guarantee, representation or consumer right that cannot lawfully be excluded or limited under applicable law.

Nothing in these Terms affects mandatory statutory rights applicable to consumers.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HauntGlow and its officers, employees, affiliates, contractors, service providers and licensors will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Services or purchase of products.

This may include loss of profits, revenue, data, business opportunities or other economic losses.

However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for certain personal injury, fraud, willful misconduct or mandatory consumer rights.

Where liability cannot legally be excluded, it will be limited to the maximum extent permitted by law.

SECTION 18 — INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless HauntGlow and its affiliates, officers, directors, employees, agents, contractors, licensors and service providers from claims, losses, liabilities and reasonable expenses arising from:

  1. your violation of these Terms;

  2. your unlawful use of the Services;

  3. your violation of another person's rights; or

  4. your fraudulent or intentionally wrongful conduct.

This section does not apply to the extent that the claim results from HauntGlow's own unlawful conduct or where such indemnification is prohibited by applicable law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms, together with our other applicable policies, constitute the agreement governing your use of the Services and supersede prior agreements concerning the same subject matter.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such consent is required.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, corporate restructuring or similar transaction, subject to applicable law.

SECTION 22 — GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except to the extent that mandatory consumer protection laws of the customer's jurisdiction apply.

Subject to applicable law, disputes relating to these Terms or purchases from HauntGlow shall be brought before the courts located in Harris County, Texas, United States.

Nothing in this section prevents a consumer from exercising mandatory rights or bringing a claim in a jurisdiction where applicable law gives that consumer the right to do so.

The headings used in these Terms are provided for convenience only and do not affect the interpretation of these Terms.

SECTION 24 — CHANGES TO THESE TERMS

We may update or modify these Terms from time to time.

The most current version will be posted on this page with the applicable "Last updated" date.

Changes become effective when posted unless a different effective date is stated.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
